Product: Rock Identifier (the “App” or the “Service”)
Operator: the developer of Rock Identifier (“we”, “us”, or “our”)
Contact: [email protected]
These Terms of Use are a contract between you and the developer of Rock Identifier. They apply when you download, access, or use the App. Please read them with our Privacy Policy. If you do not agree, do not use the App.
If a translation of these Terms differs from the English version, the English version controls, except where the mandatory law of your country gives you additional rights.
1. The Service
Rock Identifier lets you photograph a rock or mineral, or choose a photo from your library, and receive an automated identification suggestion. Related features include a photo-quality check, History, Collection, mineral guides, a market-price guide when content is available for that mineral, and an optional Pro membership.
A result is an estimate for personal, educational, and hobby use. It is not a laboratory assay, gemmological certificate, geological survey, safety assessment, legal opinion, or appraisal. It is not advice to buy, sell, mine, cut, treat, or rely on a specimen for construction, investment, radioactivity, toxicity, or any regulated use. Similar-looking minerals can be misidentified. You are responsible for any decision you make after reading a result.
Confidence labels describe the strength of the visual match. They are not a guarantee of accuracy, authenticity, value, or legality.
2. Eligibility
You must be at least 13 years old, or older if the law of your country requires a higher age to use the App or to enter a contract. The App is not directed to children under 13. If you use the App for an organisation, you confirm that you have authority to bind that organisation to these Terms.
3. Accounts
You may use the App as a guest. You may also sign in with email and, where the App offers it, with Google or Apple. You are responsible for activity under your session and for keeping your email account and device secure. Tell us at [email protected] if you believe your account is being misused.
We may refuse, suspend, or close access if we reasonably believe there is fraud, abuse, a security risk, or a breach of these Terms. Cross-device sync of Collection and History, when available, requires both a signed-in account and an active Pro entitlement. Guest data stays on the device that created it, except for the identification request you send to our servers.
4. Free allowance
A free session may complete a limited number of reliable named identifications per local calendar day. The App shows the current allowance before you depend on it. At the date of these Terms that allowance is three. A quality-check failure, cancellation, timeout, or result with no reliable name is designed not to consume the allowance. We may change the allowance for future use by updating the App, provided we do not reduce a Pro entitlement you have already paid for during its current period.
5. Pro subscriptions
Pro is an optional auto-renewable subscription sold by Apple App Store or Google Play. Plans offered in the App are weekly, monthly, and yearly. A promotional yearly plan may also be shown. The title, length, price, price per unit where the store displays one, and any free trial or introductory price are shown in the App and on the store payment sheet before you confirm. Prices vary by country and store account and can change for a future period as the store allows.
Pro removes the daily identification limit and unlocks the paid features described on the paywall at the time you subscribe. Restore Purchase checks the store account for an existing subscription. We do not receive your full payment card number.
5.1 Billing, renewal, and cancellation
If you buy through Apple:
- Payment is charged to your Apple ID at confirmation of purchase.
- The subscription renews automatically unless you turn off auto-renew at least 24 hours before the end of the current period.
- Your account is charged for renewal within 24 hours before the end of the current period, at the price of the selected plan shown by Apple.
- You can manage or cancel in your App Store account settings after purchase.
- If a free trial is offered, any unused part of that trial is forfeited when you purchase a subscription, where Apple’s rules require that result.
- Open the system subscriptions page from https://apps.apple.com/account/subscriptions.
If you buy through Google Play:
- Payment is charged to your Google Play account at confirmation of purchase.
- The subscription renews automatically unless you cancel at least 24 hours before the end of the current period.
- You can manage or cancel in Google Play under Payments and subscriptions.
- Open the Play subscription page for this App from the subscription settings Google provides for package app.rocks.com.
Deleting the App, deleting app data, or deleting your Rock Identifier account does not cancel the store subscription. Refunds are handled by Apple or Google under their rules. We cannot cancel a store subscription from inside the App.
A free trial or introductory price is available only when the store presents that offer on your account. We do not promise that every account will see a trial.
6. Apple App Store terms
If you downloaded the App from the Apple App Store, you and we agree that:
- These Terms are between you and the developer of Rock Identifier only, not with Apple. Apple is not responsible for the App or its content.
- The licence is limited, non-transferable, and revocable, and lets you use the App on Apple-branded products that you own or control, as Apple’s Usage Rules allow.
- Apple has no obligation to provide maintenance or support for the App.
- If the App fails to conform to an applicable warranty, you may notify Apple, and Apple may refund the purchase price for the App itself, if any. To the maximum extent permitted by law, Apple has no other warranty obligation. Any other claim, loss, liability, damage, or cost arising from a failure to conform is our responsibility.
- Apple is not responsible for claims by you or a third party relating to the App or your possession or use of it, including product-liability claims, a claim that the App fails to meet a legal or regulatory requirement, and claims arising under consumer protection or similar legislation.
- If a third party claims that the App, or your possession or use of it, infringes that party’s intellectual-property rights, we, not Apple, are responsible for the investigation, defence, settlement, and discharge of that claim, to the extent required by Apple’s terms.
- You represent that you are not located in a country subject to a US Government embargo and that you are not listed on a US Government prohibited or restricted-party list.
- You must comply with applicable third-party terms when you use the App, including your wireless-data agreement.
- Apple and Apple’s subsidiaries are third-party beneficiaries of these Terms. Once you accept these Terms, Apple may enforce them against you as a third-party beneficiary.
- Questions, complaints, or claims may be sent to [email protected].
7. Google Play
If you downloaded the App from Google Play, Google is not a party to these Terms. Google Play’s terms apply to the download, billing, and refund channels Google operates. Our responsibility for the App is as stated in these Terms.
8. Your content
You keep your rights in the photos and text you submit. You grant us a worldwide, non-exclusive licence to host, reproduce, process, transmit, and display that content only as needed to operate the Service, including sending a specimen image to our servers and to the identification provider named in the Privacy Policy, storing a result you save, and showing it back to you.
You confirm that you have the rights needed to submit the content and that it does not violate law or anyone else’s rights. We do not sell your photos as a dataset.
9. Acceptable use
You agree not to:
- Break the law, or infringe privacy, intellectual-property, or other rights of others.
- Upload unlawful, hateful, or sexually exploitative content, or any content involving a minor.
- Bypass a quota, paywall, device limit, or security control, or access the Service through automated scraping or an unauthorised client.
- Reverse engineer the App except where a mandatory law allows it.
- Present an identification result as a certified laboratory report, appraisal, or official valuation.
- Interfere with the Service, other users, or our providers, or attempt to extract model outputs in bulk.
- Misuse another person’s account or store purchase.
We may remove content or suspend access when we reasonably believe this section has been breached.
10. Third-party services
The App depends on Apple, Google, our hosting providers, Adjust, and an AI model provider. Their terms and privacy policies govern their own services. A store outage, model outage, or network failure can delay or prevent an identification. We are not responsible for a third-party store’s payment decision.
11. Intellectual property
The App, its software, design, text we wrote, and our trademarks belong to us or our licensors. These Terms give you a personal, limited, non-exclusive, non-transferable, revocable licence to use the App for its intended purpose. You do not receive any other right in our intellectual property. Mineral names, guide text, and market-price material may come from reference sources and are provided for identification context, not as a quotation or an offer to buy or sell.
12. Disclaimers
To the maximum extent permitted by law, the Service is provided “as is” and “as available”. We disclaim warranties of merchantability, fitness for a particular purpose, title, and non-infringement, and we do not warrant that an identification will be accurate, complete, uninterrupted, or error-free.
Some jurisdictions do not allow certain disclaimers. In those jurisdictions, the disclaimers apply only as far as the law allows. Nothing in these Terms excludes a non-waivable consumer guarantee.
13. Limitation of liability
To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, lost goodwill, or the value of a specimen, arising out of or related to the Service or these Terms.
Our total liability for all claims relating to the Service in a 12-month period is limited to the greater of the amount you paid us for the Service during those 12 months or USD 50.
These limits do not apply to liability that cannot legally be limited, including liability for fraud, or for death or personal injury caused by negligence, or any other liability that a mandatory consumer law does not allow us to exclude. If you are a consumer in the EEA, the United Kingdom, or another place with mandatory consumer remedies, you keep those remedies.
14. Ending use
You may stop using the App at any time. Delete all data and Delete account work as described in the Privacy Policy. We may suspend or stop providing the Service if you materially breach these Terms, if we must do so for security or law, or if we discontinue the App. If we discontinue a paid period early for our own convenience and the store does not already refund you, you may contact [email protected] and we will follow the refund route the store provides.
Ending these Terms does not cancel an Apple or Google subscription. Sections that by their nature should survive, including intellectual property, disclaimers, liability limits, and Apple’s third-party-beneficiary right, survive termination.
15. Changes
We may update these Terms by posting the new version at https://rock.relaxlio.com/terms/ and changing the “Last updated” date. If a change is material, we will provide any additional notice the law requires. If you continue to use the App after the effective date, the updated Terms apply, except where the law requires your express acceptance.
16. Law and disputes
Mandatory consumer-protection laws of your country of residence apply where they cannot be waived. Subject to those laws, these Terms are governed by the laws that apply to the developer’s contracting entity, without regard to conflict-of-law rules that would select another law.
Courts of your place of residence may have non-waivable jurisdiction over a consumer dispute. Nothing in these Terms requires you to bring a consumer claim in a forum the law does not allow, or prevents you from using a small-claims or online-dispute process the store provides.
